These Terms of Service apply to all video production services provided by me, Harry Green, trading as FilmedByHarry (“I”, “me”, “my”), to you, the client (“you”, “your”). By booking my services, accepting a quote, or making any payment towards a project, you confirm that you have read, understood, and agreed to these Terms in full.
These Terms are intended to work alongside any individual project agreement, quote, or invoice issued for a specific piece of work. If there is any conflict between these Terms and a project-specific agreement, the project-specific agreement will take priority.
Services
I provide video production services which may include planning, filming, editing, and delivery of video content depending on the needs of each individual project. The exact scope of work, deliverables, timelines, and any specific requirements will always be confirmed in writing before the project begins.
Anything that is not explicitly included in the agreed scope of work will not be considered part of the project and may be treated as additional work, which could be subject to further charges.
Copyright and Ownership
Unless otherwise agreed in writing before the project begins, I retain full copyright and ownership of all raw footage, project files, and any unused material created during the production process. This includes all underlying assets and working files used in the creation of the final video.
Once full payment has been received, you are granted a non-exclusive and non-transferable licence to use the final delivered video in line with the agreed purpose of the project. This licence allows you to use the video for your business marketing, including on your website, social media platforms, internal communications, and general organic promotion.
This licence does not grant permission to sell, redistribute, or transfer the video to third parties as a standalone product. It also does not allow for significant alteration of the final delivered video in a way that changes its meaning, quality, or intent, beyond basic formatting adjustments required for different platforms.
Portfolio Use
Unless you specifically request otherwise in writing before the project begins, I reserve the right to use completed work for my own promotional purposes. This may include displaying the final video or selected clips on my website, social media channels, or portfolio as examples of my work.
If a project is sensitive or confidential, it is your responsibility to notify me in advance so this can be agreed upon before production begins.
Paid Advertising and Extended Usage
Use of any delivered video in paid advertising campaigns is not included unless explicitly agreed in writing before the project begins. This includes, but is not limited to, paid social media advertising, YouTube advertising, television broadcast, or any other paid media placements.
Where usage extends beyond the original agreed scope, including additional platforms or advertising usage, an additional licensing fee may apply. Any extended usage must be agreed in writing before publication.
Revisions and Edits
The number of revision rounds included in any project will always be confirmed in the project agreement. Minor adjustments within the agreed scope are included as part of the standard service.
Any additional revisions, or changes that fall outside of the original brief, may be subject to additional charges. Once a final version has been approved by you, any further changes will be treated as new work and may incur additional costs.
You are permitted to format or adjust the video for different platforms, such as cropping or resizing, but you may not significantly alter the content or edit the video in a way that changes its original meaning or quality without prior permission.
Payment Terms
Payment terms will be outlined in your project agreement or invoice. I reserve the right to pause work or withhold delivery of final files until full payment has been received, unless otherwise agreed in writing.
In the event of non-payment or late payment, I may delay delivery or suspend work until the account is brought up to date. Ownership and usage rights of the final content remain with me until full payment has been completed.
Cancellations
If a project is cancelled, you may still be responsible for payment of any work completed up to the point of cancellation, as well as any costs or expenses already incurred on your behalf. If a deposit has been taken, this is generally non-refundable unless otherwise stated in writing.
If cancellation occurs after work has started, you may also be charged for time reserved or committed to the project.
Liability
While I always aim to deliver work to a professional standard, I cannot be held responsible for any indirect or consequential losses arising from the use or inability to use the delivered content. This includes loss of business, revenue, or opportunity.
Once content has been delivered and approved, responsibility for how it is used lies with you, including ensuring that it complies with all applicable laws, regulations, and platform requirements.
Changes to These Terms
These Terms may be updated or amended from time to time. However, the version in effect at the time of your project agreement will apply to that specific project and will not be changed retrospectively unless agreed in writing by both parties.
Agreement
By booking my services, accepting a quote, or making payment towards a project, you confirm that you are entering into an agreement with FilmedByHarry (Harry Green) under these Terms, together with any specific project agreement or invoice relating to the work.
